PRIVACY POLICY
1. Basis
In accordance with the Privacy Act, Elevex Inc (hereinafter “Elevex”) is committed to protecting all personal information collected from its customers, suppliers, and employees. This policy describes the standards for the collection, use, disclosure and retention of your personal information and your right of access to it.
2. Definitions
2.1. Personal information:
Personal information is defined as information, or a combination of information, about an identifiable natural person, such as name, date of birth, social insurance number, mailing address, e-mail address, telephone number, financial information, etc. Personal information may include, but is not limited to, an individual’s name, date of birth, address, e-mail address, telephone number, and other personal information. On the other hand, an individual’s name, and professional details (job title, business address, telephone number and e-mail address) are not personal information.
2.2. Non-personal information:
Non-personal information includes any type of information other than that included in paragraph 2.1. of this policy, such as an individual’s business contact information. Anonymous information or information that does not relate to an identifiable individual (e.g. online browsing data) is also considered non-personal information.
3. Consent
When you submit personal information to Elevex, you consent to the Elevex collection, use and disclosure of that information for the purposes described in this Policy or as otherwise specified at the time of collection.
Elevex undertakes to use the information provided for the purposes for which it was collected and to retain it for as long as necessary to perform the service requested or to study the application in the case of a job application unless a specific retention period is provided for by an applicable law or regulation.
You may withdraw your consent at any time and unsubscribe from our mailing lists and any other form of electronic communication.
4. Personal information collected and purposes
Personal information may be collected and retained by Elevex for the following purposes:
- Processing warranty claims.
- Invoicing and after-sales follow-up.
- Basic communications.
- Product or service recommendation.
- Compliance with any legal requirements.
- Supply of requested products.
- Process credit applications.
- Allow external service providers to assist us in running our business by providing marketing services, collection of overdue accounts, product delivery, payment processing.
4.1. Employee personal information
Employee personal information is personal information related to an individual’s pre-employment, employment, and termination phases with Elevex. The purpose of collecting this information is to:
- Enable Elevex to manage and pay its employees.
- Manage employee welfare programs such as group insurance.
- To allow external service providers to assist us in managing our business by providing employee file management, employment injury file management, background checks or other services.
5. Methods of collecting personal information
Elevex collects personal information in a variety of ways, including:
- Credit applications and verifications.
- Purchase, lease, service and other commercial agreements.
- Surveys, market research and other sources of commercial information such as credit agencies.
- The information request form on www.elevex.ca in the “write to us” section.
- Information collected in the normal course of business or working relationships (telephone conversations, in person, by e-mail, etc.).
- Information collected via a third party who has authorized Elevex to disclose it in the course of its business, under its own privacy policy, or otherwise in compliance with applicable laws.
6. Digital Information from Devices
Elevex may collect information from your computer and software, which may include: your IP address, browser type, operating system, domain name, access times and referring Web site addresses. Elevex also collects information about specific pages viewed on its web server and applications. Elevex does not link your IP address to any personal information you provide via our web site, but it may be used to profile you for the duration of a session and to gather broad demographic and aggregate information about people who visit our web site.
For some Web applications, Elevex uses “cookies”, which are pieces of information that a Web site transfers to your computer to make it easier for you to communicate and interact with the site. Cookies help us provide personalized content and are an integral part of some of our Web applications. You can prevent or restrict the installation of cookies on your computer, or remove them from your browser, by modifying your browser preferences. However, blocking certain cookies may impair site functionality. Elevex does not use cookies to retrieve information from your computer for purposes unrelated to the service offered on that site or your interaction with that site.
7. Protection of personal information
Elevex is committed to protecting your personal information from loss, theft, unauthorized access, disclosure, use or modification through the implementation of internal policies and practices that are communicated and enforced locally across the company.
8. Sharing personal information
We do not trade, sell, rent, or give your personal data to third parties for marketing purposes, unless you expressly give us your consent. However, we may share your information with external service providers who assist us in running our business (e.g. financial partners for credit application processing, service provider for pre-employment screening, etc.). We take steps to ensure that these third parties adhere to rigorous security and confidentiality standards.
Elevex may disclose your personal information as required or permitted by law. In certain circumstances, we may collect, use, or disclose personal information without your knowledge or consent. Such circumstances arise when, for legal, medical or security reasons, it is impossible or unlikely to obtain your consent, or when the information is necessary to investigate a possible breach of contract, to prevent or detect fraud, or to enforce the law.
9. Retention of information
Elevex retains your personal information only as long as necessary for the fulfillment of those purposes or as required by law or contract. Personal information is destroyed in accordance with the law and our records retention policy. When it is no longer necessary for Elevex to retain it, or if it is simply not retained, documents containing personal information are securely destroyed through a document destruction service or by deleting them from computer software or hardware.

10.1. Requests for access, accuracy, deletion and complaints
Any request for access, modification to ensure accuracy or deletion of personal information must be made by e-mail to the attention of the Privacy Officer. Requests must contain sufficient information to prove the identity of the requestor and identify the information requested.
We will provide you with this information within a reasonable time from the date of receipt of the written request. Costs may be associated with your access request and may be required depending on the nature and scope of your request (e.g. photocopying costs).
A request for access, modification or deletion may be refused if disclosure of the information would result in the disclosure of another person’s personal information. In such a case, you will be notified in writing of the reasons for the refusal.

11. Changes to the Policy
This Policy is effective as of the date indicated at the top of this document. Elevex reserves the right to update or modify this Policy at any time and from time to time without notice. You are invited to review it periodically.
